Demystifying same-sex marriage: All you need to know to get married in Portugal.

In 2010 Portugal became the sixth country in Europe to allow same-sex marriage. It gives the couple the same legal rights as heterosexual couples. The marriage documents required and process for marriage are the same as any civil wedding and no temporary residency whatsoever is required.

The documents required by both marriage partners are:

  • Passport
  • Certified birth certificate
  • A certificate of no impediment
  • In the case of a previous marriage a certified copy of the death certificate of the deceased spouse or a certified copy of the final divorce decree

Although in Portugal same-sex weddings can’t take place in a church or chapel, couples can choose from a number of beautifully romantic places to marry, including white sand beaches, dramatic cliff tops, taking beach front hotels, luxury stunning palaces and rustic farmhouses, making the most of the country’s warm sunshine and views.

What we do the days before your wedding day

Wondering what’s our role as your wedding planner when your big day in Portugal is around the corner?

Where we are and what we worry about?

We will be in Portugal onsite before the day to make sure all setups are completed on time and suppliers are fully briefed on timings and events during your wedding. More in detail:

> A few days before the big day

We will establish the last contacts and visits to suppliers to ensure there are no delays: flowers have been received by the florist, DJ has all your chosen songs compiled and ready, fireworks have been delivered, stationary is ready and impeccable, wedding favours are ready, photographer and videographer are fully briefed of your preferred wedding pictures, transportation for you and your guests is scheduled, etc.

> The day before the big day

On the day prior to your wedding day, we will visit the wedding cake artist, and will be fully there with the decoration and catering teams, setting up the tables, decorating the reception room, the ceremony room or church, making the final arrangements such as wedding bathroom baskets and setting the cards with the guest names on the tables.

> On your wedding day

When your wedding day finally arrives we will contact early morning your make-up and hair artists, your ceremony musician and the registrar or priest to ensure no unforeseen delays. We will be onsite from before the time that the flowers are delivered to the room of the Bride on the morning of the wedding. We will meet guests to make sure they get the organised transport.

Throughout the whole day we will be extremely discreet wearing a black/dark blue attire. We are there to help organise your guests and solve any problems that may occur and will be your point of contact for suppliers and venue so you are not bothered with details.

Documents, process and timelines for your Portuguese Civil Wedding

Here is something everyone planning a wedding in Portugal needs to be aware of: required documents, process and timelines.

To get legally married in Portugal no temporary residency whatsoever is required.

A marriage in Portugal is recognized abroad in all European Union countries and in most countries outside the EU. But you must have this confirmed through your local authorities or your embassy or consulate in Portugal.

The documents with certified translation required by both marriage partners are:

  • Passport
  • Certified birth certificate issued no more than six months prior to the application
  • A certificate of no impediment issued no more than six months prior to the application
  • In the case of a previous marriage a certified copy of the death certificate of the deceased spouse or a certified copy of the final divorce decree (men must wait 180 days -6 months- before they may remarry and women must wait 300 days – 9 months)
  • Parental or Guardian Consent if you or your partner are under the age of 18
  • Fee (this changes from year to year so it’s best to check beforehand)

The process starts by handing in to the competent authorities in Portugal the documents above mentioned. This can be done either by the couple directly or by someone legally appointed by the couple to represent on this matter.

The couple will have to choose one of the 4 marital regimes available in Portugal. The default system is marriage in community of property (Comunhão de adquiridos).In this case pre-nuptial agreements should be drawn up to alter this in any way should you wish to do so.

The four marital regimes are:

  1. Community of property (Comunhão geral): All property brought to the marriage and acquired during the marriage is communal. This marital regime cannot be chosen if one or both of the marrying parties already has children.
  2. “Acquired” community of property (Comunhão de adquiridos): only goods and property acquired after the marriage are communal.
  3. Out of community of property (Separação geral de bens): The law imposes this marital regime when one or both of the couple are aged sixty or more.
  4. Other: Portuguese law allows couples to choose their own marital regime, or combine certain characteristics of the three above.

Once everything is legally completed and approved couples must get married within 6 months from the approval date. This means that couples should not start organising the process 6 months prior to the wedding date but no later than 1 month before the wedding date.

How to deal with your dilemmas when it comes to inviting your guests

1. You are allowed only a limited number of guests in your ceremony room and you’re not sure how to deal with this limitation?

1.1 Choose your guests

Generally when this happens couples chose the guests they want to come into the room and are happy for plus ones  to wait outside or in a bar and join them at the reception.

As a note this rarely happens when you get married in Portugal.  All the weddings we planned in Portugal had enough space for everyone in both the ceremony and reception, so this would never be an issue for you.

2. You have room for some more evening guests who weren’t initially invited due to room but now you have more space available and would like to invite them and not sure how to do it?

Send them the same invite as your other evening guests had, or if you prefer just call them up and ask them directly.

3. How long in advance should you send out your save the date cards? How long after should you send your wedding invites and when should you ask for RSVP by?

Generally couples send their ‘save the date’ cards as soon as they have decided on the date and booked both the registrar/church and the venue.

For weddings abroad, the invites would follow anything between 1 year to 6 months prior to the wedding date, and the RSPV date a couple of weeks before you need to know the final numbers.

For local weddings, the invites would follow anything between 5 months to 2 months before the wedding date. The same principle applies for RSPV date.

How important are wedding favours?

Whilst planning weddings in Portugal for our couples we experienced that decisions on wedding favours have several times not been straight forward. Our couples seem to dwell on the relevance or importance of having wedding favours.

In the majority of the weddings we planned our couples seemed to agree that wedding favours are a nice touch to the wedding, and therefore gone ahead with them.

However couples tend to raise 3 main arguments against wedding favours:

  1. Tables look neater without them
  2. Tight wedding budget
  3. They are a waste as guests don’t seem to care much

But there are a few ways we can go around these arguments.

  1. If you are on a tight budget, wedding favours don’t need to be expensive and the best thing is couples can even do them themselves!
  2. If you feel that wedding favours are a waste or fear they might not be appreciated, then you might consider donating to cancer research, charities, or any other noble cause for your wedding favours. In turn you tend to get bracelets, cards or pins so you can put them on each table.
  3. Alternatively, you might prefer to have other things instead of wedding favours. Below a list of our couples most chosen:
  • Thank you tags saying e.g. ‘thank you for sharing first day as Mr and Mrs’
  • Cookies
  • Candy floss, popcorn
  • Caricature for the reception
  • Sweet cart
  • Flip flop basket
  • Sun glasses basket
  • Pimms, wine and/or champers
  • Personalised love hearts

And if there is children:

  • Small sweet table
  • Bubbles and sweet cones
  • Sweets in mini jars
  • Kids face painting
  • Balloons

And our favourite so far – have sparklers and a tag made for each person with a nice saying like ‘let love sparkle’ and light them outside as the first dance starts. Romantic, memorable, perfect.

As with most things wedding related, wedding favours are only important if they’re important to the couple. Truth to be told we’ve never heard anyone coming away of a wedding saying “the favours were rubbish” or “how terrible that they didn’t have any favours”. So there is not right or wrong, simply a personal choice.

If this is how you feel, you’re not alone. I have worked with so many brides that whilst planning their weddings in Portugal shared this same concern.

It is not your fault, it’s no one’s fault really. It does not mean you are not cut out to get married, or your fiancé is not the one after all, or anything else that might be crossing your mind.

Many of these brides simply hate being the centre of attention and the fact of people staring at them on their wedding day worries them.

And different people experience different levels of interest in their wedding day. Some people like the wedding planning to be the centre of their focus. So just because it’s not for you it doesn’t mean it’s wrong. The important thing is that you are marrying the partner that you love nothing else is really important.

So stop feeling guilty about it and take all the pressure out of your shoulders. The less you think about it the more relaxed you will start feeling about your wedding day.

How to solve your dilemas when it comes to seating plan for your wedding

From our experience in planning weddings in Portugal couples have 3 main dilemmas when it comes to putting down the seating plan:

  1.  Wondering if I should keep family together or split everyone up?
  2.  Not sure where to seat my parents that are divorced?
  3. When should I print the final plan?

1. Should I keep family together or do I split everyone up?

There is no right or wrong answer as it depends on each family dynamics. Usually couples tend to keep family together and friends are put in groups that get on.
The most important thing is if you have a few friends ensure that if you split them up around the tables they know at least one other person on the table.

2. Where should I seat my parents since they are separated?

A common dilemma faced by couples when organising the seating plan is where to seat their separated parents.

The easiest way would be to address this concern with both your parents and see how they feel about it. They might surprise you and not mind seating next to each other. After all it’s their child getting married.

But more likely you would have to seat them apart.  The trick is on deciding what table seating plan suits you best.

Two seating plans would definitely work in this situation: traditional top table facing guests or alternatively a round/square table placed in the centre of the room (you can see these in the seating plan illustrations below).

In both options you have the possibility to sit just the two of you, having a  ‘bride and groom table’  and allocate your parents a table each. If the idea of being just the 2 of you in one table is not for you, the suggestion would be to sit them in your table  intercalating them with your partners family. If both your parents are divorced, you may need four parents’ tables.

3. When should I print the seating plan?

You should try and leave it until about a week before if you can. Just make sure wherever you are printing it they are aware they need to do it and you give them enough time to have it ready just before your big day.
